1. Acceptance of Terms

By accessing or using the services provided by Drivonix ("Company," "we," "our," or "us"), you ("Client" or "you") agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our services. We reserve the right to modify these Terms at any time, and such modifications will be effective immediately upon posting on our website.

2. Description of Services

Drivonix provides car buying advocacy services, including but not limited to:

  • Vehicle consultation and selection assistance
  • Dealer negotiation on behalf of clients
  • Price research and market analysis
  • Trade-in value assessment and negotiation
  • Financing guidance and lender comparison
  • Warranty and protection plan review
  • Paperwork coordination and delivery assistance

We act as your advocate and representative in dealings with automotive dealerships, working exclusively in your best interest throughout the car buying process.

3. Service Packages and Fees

3.1 Drivonix Select Package - $899

For clients who know the exact vehicle they want and prefer professional management of negotiations, dealer communication, and logistics.

3.2 Drivonix Premium Package - $1,699

Our most comprehensive service, providing expert guidance through every step of the car buying process, from vehicle selection to final delivery.

3.3 Drivonix Consultation Package - $499

For individuals who want a clear, professional game plan before negotiating at the dealership themselves.

4. Payment Terms

Service fees are due as follows:

  • A non-refundable deposit of 50% is required to initiate services
  • The remaining balance is due upon successful completion of vehicle purchase or delivery
  • We accept major credit cards, debit cards, and bank transfers
  • All fees are in US dollars unless otherwise specified

5. Client Responsibilities

As a client, you agree to:

  • Provide accurate and complete information regarding your vehicle requirements and budget
  • Respond promptly to communications and requests for information
  • Make final purchasing decisions in a timely manner
  • Complete all necessary documentation for vehicle financing and registration
  • Notify us immediately of any changes to your requirements or circumstances
  • Not engage directly with dealerships we are negotiating with without our knowledge

6. Scope of Representation

Drivonix acts as your advocate in negotiations with automotive dealerships. We do not sell vehicles, act as a licensed dealership, or provide financing directly. Our role is advisory and representational. The final decision to purchase any vehicle rests solely with you, and you enter into purchase agreements directly with the selling dealership.

7. No Guarantee of Savings

While we strive to negotiate the best possible deal on your behalf, we cannot guarantee specific savings amounts, vehicle availability, or dealer acceptance of our negotiated terms. Market conditions, dealer policies, and vehicle demand may affect outcomes. The Consultation Package does not guarantee savings as negotiations are executed by the client.

8. Limitation of Liability

To the fullest extent permitted by law, Drivonix shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or related to your use of our services. Our total liability shall not exceed the amount of fees paid by you for the specific service in question.

9. Indemnification

You agree to indemnify, defend, and hold harmless Drivonix, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or related to your use of our services, your breach of these Terms, or your violation of any law or rights of a third party.

10. Cancellation and Refunds

Cancellation policies are as follows:

  • Cancellation before services begin: Full refund minus a $100 administrative fee
  • Cancellation after services have begun: Deposit is non-refundable
  • If we are unable to locate a vehicle meeting your specifications within 60 days, you may request a full refund
  • Refunds are processed within 10 business days

11. Confidentiality

We maintain strict confidentiality regarding your personal and financial information. We will not disclose your information to third parties without your consent, except as necessary to provide our services or as required by law. You agree not to disclose our proprietary negotiation strategies or methods to third parties.

12. Intellectual Property

All content on the Drivonix website, including text, graphics, logos, images, and software, is the property of Drivonix and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.

13. Dispute Resolution

Any disputes arising out of or relating to these Terms or our services shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in the state where Drivonix maintains its principal place of business.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States and the state in which Drivonix is incorporated, without regard to conflict of law principles.

15. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable.

16. Entire Agreement

These Terms, together with our Privacy Policy and any service-specific agreements, constitute the entire agreement between you and Drivonix regarding your use of our services and supersede all prior agreements and understandings.
